Facts
The State of Indiana (defendant) enacted a statute that prohibited the wasting of oil and gas resources. Oil and gas that was dispersed without use or benefit to anyone constituted waste. Because of the peculiar nature of oil and gas, the legislature used its power to protect the correlative rights of the common owners of natural resources. Ohio Oil Company (plaintiff) challenged the validity of the statute.
