Facts
Bradley Kingery (defendant) was charged with domestic violence against Melissa Tackett. Tackett’s treating physician, Dr. Romano, testified at trial about statements that Tackett made to him during his examination of her. In addition, the trial court admitted Tackett’s medical records into evidence. The medical records contained an identification of Kingery as the abuser. Tackett testified and identified Kingery as the assailant in her testimony. Kingery was convicted, and he appealed, arguing that the medical records were inadmissible hearsay.
