Facts
Sam (plaintiff) and Carolina (defendant) Olivas divorced. They had held their property as tenants in common, but about two months before the divorce, Sam chose to move out of their house and Carolina remained in possession. Sam brought an action for rent, claiming that he was constructively ousted from the house. The district court found in favor of Carolina. Sam appealed.
