Facts
Orient Shipping Rotterdam B.V. (Orient) (plaintiff) owned a vessel that it chartered to Hugo Neu & Sons, Inc. (Hugo) (defendant) to deliver scrap to Bombay. When Hugo arrived at the Bombay port, there was port congestion caused by the arrival of several other vessels and a lack of trucks for offloading vessels. Hugo eventually offloaded the scrap, but long after the scrap was supposed to be offloaded from Orient’s vessel. Orient sued Hugo for demurrage fees caused by the delay. The charter contract between Orient and Hugo relieved Hugo from demurrage liability if a delay occurred by “cause or causes whatsoever.”
