Facts
The Orndorffs (plaintiffs) bought a house built on defectively compacted soil. Other than the defect, the Orndorffs loved the house and did not want to move. The Orndorffs sued the builder, Christiana Community Builders (defendant), for damages. The Orndorffs presented evidence that settlement of the soil would continue and that the best way to fix it would be to install a pier and grade system on the property. The Orndorffs presented evidence that it would cost $221,792.68 to install the system. They also presented evidence that the repairs would cost them $21,747 in additional costs and fees, including relocation expenses during the repairs. The house was worth $238,500 absent the defect but only $67,500 in the defective condition. The trial court awarded the Orndorffs the full $243,539.95 in damages. Christiana appealed.
