Facts
In 1993, the City of Philadelphia adopted an ordinance banning certain types of assault weapons in the city. Subsequently, the Pennsylvania legislature passed a law prohibiting municipalities from regulating the ownership, sale, and purchase of assault weapons. Philadelphia Councilman Angel Ortiz (plaintiff) sued the Commonwealth of Pennsylvania (defendant), seeking an order enjoining the commonwealth’s preemption of the ordinance.
