Facts
Oster (plaintiff) was executive secretary to the New England Hebrew Academy (defendant). Oster attempted to call an annual meeting of the Academy, but his action was not authorized by the Academy’s board of directors. The board cancelled the meeting, and the Central Committee of Chabad-Lubavitch Rabbis, which the Academy was part of, called Oster to appear before its rabbinical court. Oster replied that Oster might prefer to be heard before a different type of religious hearing as allowed under the organization’s rules. The Committee sent another notice to Oster that he had to appear before the rabbinical court. Oster sued in civil court, arguing that Oster had the option to choose what type of religious hearing that Oster would have.
