Facts
Owens-Corning Fiberglas Corp. (defendant) manufactured Kaylo for approximately 30 years. Kaylo was an insulation product that contained asbestos. Owens-Corning learned that exposure to asbestos dust caused mesothelioma, a deadly cancer of the lining of the chest, and other lung diseases. However, Owens-Corning concealed this information from the public and only removed asbestos from Kaylo years later. The jury awarded the plaintiff $1.6 million in compensatory damages and $3.7 million in punitive damages. Owens-Corning appealed, arguing that multiple punitive-damage awards for the same conduct violate substantive due process.
