Facts
William Zenobia and another (plaintiffs) sued Owens-Illinois, Inc. (defendant), alleging that the asbestos manufactured by Owens-Illinois caused them harm. The jury was instructed that punitive damages could be awarded upon a finding of implied malice, which required a finding that Owens-Illinois’ conduct was grossly negligent. The jury found in favor of the plaintiffs, and awarded punitive damages, and the appellate court affirmed the award of punitive damages. Owens-Illinois appealed the punitive damages award.
