Facts
Nusbaum obtained a patent for a combination of soft, uncured cheese and hard, cured cheese. The combination, which previously had been thought impossible, resulted in a new kind of cheese having aspects of both constituent parts but with its own flavor and consistency. The patent was assigned to the P. E. Sharpless Company (plaintiff), which brought an infringement action against Crawford Farms, Inc. (defendant) in federal district court. The court found in favor of Crawford Farms. P. E. Sharpless appealed to the United States Court of Appeals for the Second Circuit.
