P.R. v. State
Georgia Court of Appeals
210 S.E.2d 839 (1974)
- Written by Meredith Hamilton Alley, JD
Facts
Two brothers (defendants), ages 16 and 13, entered a store. A witness saw the brothers take some magazines worth $25 and then leave the store without paying. The witness called the police, who then found the brothers, whom the witness identified. The magazines were not recovered. The juvenile court found that brothers took the magazines and were therefore delinquents. The court sentenced the boys to 12-month probation on the condition that each brother pay $7.50 in restitution to the store owner. The brothers appealed. One of their arguments on appeal was that the juvenile court did not have the power to require restitution as a condition of probation.
