Facts
Eric and Diane Scoblionko (defendants) owned and operated a summer camp. In February 1985, Albert Pacheco (plaintiff) paid the camp fee and submitted the registration form for his son to attend the Scoblionkos’ camp that upcoming summer. The registration form included a clause that said if any camper had to withdraw after May 1, 1985, the camp would keep any money paid for the camper up to that point. Pacheco withdrew his son on June 14, 1985, and the Scoblionkos would not give him a refund. Pacheco brought suit, and the lower court ruled in favor of Pacheco. The Scoblionkos appealed.
