Facts
Pacific Lutheran University (PLU) was affiliated with the Evangelical Lutheran Church in America. PLU’s stated purpose was to be a learning institution in the tradition of Lutheran higher education. It had a religion department, and it actively encouraged students to engage in on-campus activities to grow their faith. However, students and employees were not required to attend or participate in religious activities or services. In addition, advertisements and the website for PLU portrayed PLU as a religious educational environment but stated that students from any religion were permitted to attend. Moreover, PLU represented itself as committed to academic freedom and accepting of other faiths. PLU’s teaching contracts, job postings, and employee handbook did not place any requirements on the faculty to be religious or to participate in religious instruction. In addition, a faculty member from the languages and literature department testified that he had not been told there was any religious requirement when he was hired. Faculty members from PLU petitioned to establish that the National Labor Relations Board (NLRB) had jurisdiction over them.
