Facts
Lloyd Aubry (defendant), California’s labor commissioner, enforced California’s overtime-pay laws against Clean Seas, an employer operating vessels off the California coast. These vessels did not engage in foreign, intercoastal, or coastwise voyages. Pacific Merchant Shipping Association (the association) (plaintiff) sued in federal district court on behalf of Clean Seas and other member companies. The association argued that California’s overtime-pay laws were preempted by federal admiralty law. The district court ruled in favor of the association, and Aubry appealed.
