Facts

The Oregon legislature enacted a statute granting the Chief of the Oregon Division of Plant Industry (plant agency) the power to promulgate a regulation setting standards for the type, size, and shape of strawberry and raspberry containers. Regulations that mandated standards for containers were promulgated after investigation, notice, and a public hearing by the Oregon Division of Plant Industry. Pacific States Box & Basket Co. (Box & Basket) (plaintiff), a box company, filed a claim in district court, arguing that the new standard violated its due-process rights because the new standard was arbitrary and capricious. The district court dismissed the claim for failure to allege facts upon which relief could be granted. Box & Basket appealed to the United States Supreme Court.
