Facts
Rodger Padula (plaintiff), a New York resident, was injured while working on a construction project in Massachusetts. The property at which Padula was injured was owned by Lilarn Properties Corp. (defendant), a New York corporation. Padula filed suit against Lilarn Properties in New York state court alleging that he was injured as a result of violations of certain provisions of New York labor law. The supreme court granted Lilarn Properties’ motion for partial summary judgment and dismissed the complaint. The appellate division affirmed the dismissal. The court of appeals granted leave to review.
