Facts
The Pagosa Area Water and Sanitation District (PAWSD) (plaintiff), a municipal water district in Colorado, sought expanded conditional rights for water storage and diversion based on anticipated needs in the coming decades. Trout Unlimited (Trout) (defendant) opposed the application, arguing that PAWSD’s asserted needs were speculative and gave PAWSD more water than it would need. Without stating the factual basis for its decision, the District Court for Water Division in Colorado issued a decree granting PAWSD storage and diversion rights based on a 100-year estimate of future needs. Trout appealed.
