Facts
Henry Palmer (plaintiff) purchased the exclusive right to print, publish, and produce a playscript from the original author. The playscript was unpublished at that time. Palmer then presented the play in theaters. Robert De Witt (defendant) somehow obtained a copy of the playscript and sold copies of it. Palmer filed suit seeking an injunction and accounting of profits. A temporary injunction was granted, but the New York Superior Court granted De Witt’s motion to dissolve the injunction. Palmer appealed.
