Facts
Dena Palmer (plaintiff) brought a federal lawsuit alleging Pioneer Inn Associates, Ltd. (Pioneer Inn) (defendant) refused to hire her on discriminatory grounds. Palmer’s attorney spoke with a Pioneer Inn supervisor without consent from Pioneer Inn’s attorney. The trial judge sanctioned Palmer’s attorney and barred testimony about statements made during the ex parte contact. The court entered judgments for Pioneer Inn. Palmer appealed. The Ninth Circuit certified a question asking the Nevada Supreme Court which test it used to decide whether contacting a represented party’s employee is prohibited.
