Facts
Palmore (defendant) was convicted of a felony under the District of Columbia Code. The trial court judge was employed under terms set by the District of Columbia Code, including a set term of office of 15 years and the possibility of removal or suspension by a judicial commission. Because Washington, D.C. was a federal territory, the District of Columbia Code was enacted by Congress. Palmore appealed his conviction, arguing that the trial court judge did not have authority to oversee a felony because he was not appointed pursuant to Article III of the United States Constitution. The United States Court of Appeals for the District of Columbia affirmed, and Palmore petitioned the United States Supreme Court for review.
