Facts
National courts of the Netherlands requested preliminary rulings from the European Communities Court of Justice on whether the World Trade Organization (WTO) Agreement on Trade-Related Aspects of Intellectual Property Rights (the TRIPs Agreement)—which was an annex to the WTO Agreement—was directly effective in European Union (EU) law. The European Communities Court of Justice had already held that the WTO Agreement, including its annexes, did not have direct effect.
