Facts
Pet stores (plaintiffs) brought an action seeking to invalidate a City of Chicago (defendant) puppy-mill ordinance, which limited the sources from which pet stores could obtain certain animals for resale. The pet stores alleged that the ordinance exceeded the city’s home-rule powers under the Illinois Constitution and violated the Dormant Commerce Clause of the United States Constitution. The district court granted the city’s motion to dismiss. The pet stores appealed.
