Facts
1-800 Bar None, A Financial Corp., Inc. (defendant) generated subprime financing leads by advertising that it could procure loans for anyone and repair their credit. When customers called Bar None, it sold these sales leads to automotive dealers. Parker (plaintiff) saw a Bar None television commercial and contacted Bar None. Parker was referred to a car dealer, who convinced Parker to write a bad check to cover the cost of the car. At that point, the dealer would hold on to the bad check until payment arrangements were made. Parker had second thoughts about her deal with the dealer and backed out. Parker gave the car back and stopped making payments. Parker sued, arguing that Bar None had misrepresented its credit-repair services in violation of the Credit Repair Organizations Act. Bar None responded that it was not a credit-repair organization as defined by the act and moved to dismiss.
