Parker v. Hoefer
Vermont Supreme Court
100 A.2d 434 (1953)
- Written by Rich Walter, JD
Facts
Mrs. Parker (plaintiff) sued Silvia Hoefer (defendant) for alienating the affection of Mr. Parker. At trial, Mrs. Parker testified she noticed Hoefer's interest in Mr. Parker, observed his abnormal behavior, and found physical evidence suggesting he was having affairs with Hoefer and another woman. Mr. and Mrs. Grant Titsworth testified they knew the Parkers and noticed changes in the couple's behavior toward each other after Mr. Parker became interested in other women. Hoefer appealed the trial verdict for Mrs. Parker to the Supreme Court of Vermont. Hoefer argued Mrs. Parker based her testimony on opinions and conclusions which were inadmissible.
