Facts
The Section 8 program was a federal program that provided financial assistance to low-income individuals so that they could rent housing from private landlords. Individuals who were approved for assistance received Section 8 vouchers. John Pasquince (plaintiff), a New Jersey resident, had a Section 8 voucher. The Section 8 voucher covered the majority of Pasquince’s rent, and Pasquince was responsible for paying the remaining portion of the rent. Pasquince submitted a rental application to Brighton Arms Apartments (Brighton Arms) (defendant). Pasquince’s credit history showed that Pasquince had failed to pay rent to a prior landlord. Brighton Arms refused to rent to Pasquince because of his poor credit history. Specifically, Brighton Arms believed that Pasquince would avoid paying the portion of the rent not covered by the Section 8 voucher. Pasquince brought suit, contending that Brighton Arms violated New Jersey law by discriminating against him on the basis of his Section 8 status. The trial court ruled in favor of Brighton Arms. Pasquince appealed.
