Facts
Mary Patchett (defendant) caused a car accident, resulting in injuries to Ashley Lee (plaintiff). Lee’s medical bills totaled over $87,000. However, Lee was a member of the Healthy Indiana Plan (HIP), a government-sponsored healthcare plan. Under HIP, Lee’s medical providers accepted just over $12,000 as full payment of the charges. The trial court granted Lee’s motion to exclude the evidence of the reduced reimbursement. The court held that discounted reimbursements imposed by the government as part of HIP were not admissible. The court also held that the evidence of the reimbursement would confuse the jury and thus should be excluded under Federal Rule of Evidence 403. The court of appeals affirmed. Lee appealed.
