Facts
The United Kingdom passed the Commonwealth Immigrants Act of 1968, which was enacted by parliament in response to an influx of Asian immigrants from Africa. Several East African Asians, who were British nationals, were denied entry to the United Kingdom and subject to special conditions in order to enter. The East African Asians filed an application with the European Commission, complaining that the United Kingdom’s actions amounted to degrading treatment and discrimination in violation of Articles 3 and 14 of the convention. The United Kingdom sought to bar the admissibility of the application, arguing that there was no international right to enter and reside in a particular country.
