Facts
Madhuri Patel (plaintiff) was the mother of a developmentally disabled minor, AH. AH was a student at a high school in the Kent School District (defendant). Per AH’s individualized education plan, AH was placed in a self-contained classroom and required to be under constant supervision. Despite these requirements, AH’s teacher allowed AH to go to the bathroom on her own. Eventually, it was discovered that AH had been having sexual encounters with another developmentally disabled student in the bathroom on multiple occasions. Patel brought suit against Kent School District under 42 U.S.C. § 1983, alleging that the failure to supervise her daughter violated her due-process rights. The district court granted summary judgment in favor of Kent School District.
