Facts
Eleanor Wai-Ching So died in a bicycle accident while visiting Yosemite National Park. Her husband, children, and estate (the Paus) (plaintiffs) sued Yosemite Park and Curry Co. (Curry Company) (defendant), from which the family had rented the bicycles. The jury found Curry Company not liable. The Paus appealed, contending that the trial court erred in admitting a statement from Alan Pau in which he opined that Wai-Ching So forgot to use the foot brake.
