Facts
New England Life Insurance Company (New England Life) (defendant) used Paolo Pavesich’s (plaintiff) photograph in an advertisement without his permission. The advertisement included a statement falsely attributed to Pavesich that encouraged people to buy life insurance from the company. Pavesich sued New England Life for breach of privacy, and the trial court dismissed his complaint. Pavesich appealed the dismissal.
