Facts
Cardell and Dahlia Payne (plaintiffs) lived in the Parkchester North Condominiums (Parkchester) (defendants) in the Bronx, New York. Cardell was allegedly beaten, pepper-sprayed, handcuffed, and arrested by Parkchester’s security guards. In 1999 the Paynes filed a lawsuit in state court that alleged that Parkchester had committed state torts and federal-constitutional-rights violations. Parkchester attempted to have the case removed to federal court and was ultimately successful in 2000. Seven months later, after some discovery had occurred, the Paynes moved to amend their complaint to remove the federal claims and remand the case to state court.
