Facts
Joanne Payton (plaintiff) worked for the New Jersey Turnpike Authority (NJTA) (defendant). Payton filed an internal complaint alleging sexual harassment by two of her supervisors. The harassment continued, and Payton sued NJTA and the supervisors for sexual harassment. Payton demanded the production of all documents relating to any investigation NJTA conducted relating to Payton’s complaint. NJTA’s motion for a protective order was granted based, in part, on the privilege of self-critical analysis. The protective order was vacated by the appellate division, and the New Jersey Supreme Court granted NJTA leave to appeal.
