Facts
Karen Sanders (plaintiff) and Scott Pearson (defendant) were married. In 1990, the marriage was dissolved, and Sanders was granted sole custody of their two children while Pearson was granted parenting time. In March 1995, Pearson filed a motion to modify his parenting time. On October 10, 1995, the trial court referred the dispute to mediation based on a state statute (the statute) that provided the court with authority to refer certain cases to mediation. On October 30, 1995, Sanders filed a motion to reconsider the mediation order based on an affidavit claiming that she had been physically and emotionally abused by Pearson during their marriage and that as a result of one injury-causing incident, Pearson had been convicted of assault and domestic violence. Sanders’s motion was denied. The Colorado Supreme Court reviewed the matter.
