Facts
The City of Bridgeport, Connecticut (city) (defendant) owned and maintained an athletic field on which the city permitted North End Eastern Little League Baseball of Bridgeport, Inc. (NELL) (defendant) to conduct youth baseball games. Camilla Peeples and her son Christopher Peeples (plaintiffs) sued the city and NELL after Christopher, in the course of one such game, fell into an outfield pothole and sustained injury. Pretrial evidence established that both the city and NELL had policies for conducting pre-game field inspections and repairs. Both NELL and the city moved for summary judgment. The trial court denied NELL’s motion on the grounds that NELL’s pre-game inspection policy and status as a permittee both imposed on NELL legal duties that a jury might find were negligently performed. The court then turned to the city’s motion.
