Facts
Linda Fazenbaker (plaintiff) sued Heather Peirce (defendant). At trial, Fazenbaker asked the court to take judicial notice of the fact that the drug Cephalexin was part of a class of drugs known as cephalosporins. The trial court took judicial notice of the fact over Peirce’s objection and ruled in Fazenbaker’s favor. Peirce appealed, arguing that the court should not have taken judicial notice of Cephalexin’s status as a cephalosporin.
