Facts
Peirick (plaintiff), a 53-year-old female, was the coach of the women’s tennis team at Indiana University-Purdue University Indianapolis (IUPUI) for 13 years. Peirick’s players performed well both athletically and academically, she received community service awards, she performed budgeting and fundraising duties appropriately, and she was never alleged to have violated any National Collegiate Athletic Association (NCAA) rules. However, several of Peirick’s athletes complained to the Athletic Director and Assistant Athletic Director of her foul, abusive language and unsafe driving during team trips. In addition, Peirick allegedly lied to her athletes, blaming a scheduling conflict with the team’s tennis center on the athletic administration, when it was Peirick who failed to schedule the tennis center in advance. Peirick was terminated and replaced with the 23-year-old sister of the men’s tennis coach. Peirick filed a lawsuit against the IUPUI, the IUPUI Athletic Department, and the Board of Trustees (defendants), alleging both gender and age discrimination. IUPUI filed a motion for summary judgment, which was granted on both claims, and Peirick appealed.
