Facts
The Commonwealth of Pennsylvania (Commonwealth) stopped paying police and park officers automatic longevity-based wage increases during a budgetary crisis in the summer of 2003. The Pennsylvania State Park Officers Association (PSPOA) and the Capitol Police Lodge 85, Fraternal Order of Police (FOP) (the unions) (plaintiffs) represented the officers under collective-bargaining agreements (CBAs) expiring June 30, 2003. The CBAs both provided for longevity wage increases. The parties failed to agree on new CBA terms and were in the arbitration process when the Commonwealth unilaterally stopped giving longevity increases. The unions filed unfair-labor-practice charges with the Pennsylvania Labor Relations Board (PLRB) (defendant) alleging the Commonwealth had unlawfully altered the status quo. The PLRB declined to issue a complaint and dismissed the unions’ exceptions to its decision. The unions appealed.
