Facts
Sinai Temple (Sinai) (defendant) was a nonprofit religious organization. Sinai bought a cemetery, which was able to turn a profit. Sinai did not distribute the profits to its members but did permit members a discount on buying cemetery plots. The California attorney general (plaintiff) sued Sinai, claiming that Sinai’s making of profits violated its status as a nonprofit corporation.
