Facts
Walter Koons (defendant) removed money from slot machines. As gambling devices, these slot machines were illegal under state law. Initially, Koons pled guilty to petit larceny, and he was sentenced to prison. He later petitioned for a writ of habeas corpus seeking release from prison. In his petition, Koons argued that his guilty plea was a nullity because the money was taken from an unlawful slot machine.
