Facts
Botkin (defendant) sent a box of poisoned candy from San Francisco, California, to Elizabeth Dunning in Dover, Delaware. Dunning received the candy, consumed it, and died. Botkin was charged with murder. At trial, the jury was given instructions contrary to established state law. Nevertheless, Botkin was convicted and she appealed.
