Facts
John Burt (defendant) solicited a female acquaintance to participate with him in an extortion scheme. Burt proposed that the woman should meet men at hotels in Los Angeles and convince the men to travel with her to Tijuana, Mexico, purportedly to engage in sex. Once in Mexico, Burt and his associates would extort money from the men. The woman reported Burt’s solicitation to the police. Burt was charged with solicitation of the crime of extortion. Burt was found guilty and filed a motion for a new trial. The motion was denied, and Burt appealed, claiming that he could not be convicted because the crime he allegedly solicited was to have been committed in another jurisdiction.
