Facts
Burton (defendant) killed an individual during an armed robbery and was convicted of first-degree felony murder. Burton appealed, arguing that the trial court erred by instructing the jury on first-degree felony murder because the underlying felony was armed robbery which precedent has held cannot support a felony-murder instruction.
