Facts
Police illegally obtained evidence against Cahan (defendant) and 15 other defendants when, without warrants, police entered and placed microphones in several homes. Police also illegally obtained evidence through several break-ins, including kicking in the door of one residence and breaking a window of another residence. The state (plaintiff) used the evidence to charge Cahan and the 15 other defendants with conspiracy to engage in horse-race bookmaking and other offenses. Cahan and 14 of the charged defendants were convicted at a bench trial and appealed.
