Facts
Campbell (defendant) and Basnaw were drinking heavily. Campbell was angry with Basnaw for sleeping with his wife and encouraged Basnaw to kill himself. When Basnaw said he had no weapon, Campbell gave Basnaw his gun with five shells and left. Shortly thereafter, Basnaw shot and killed himself. Campbell was charged with murder, but moved to dismiss the charge on the ground that homicide cannot be based on the act of giving a weapon to a person who subsequently uses it to commit suicide. The circuit court denied Campbell’s motion and he appealed.
