Facts
Curtis (defendant) shot and killed Macon Wilson who had been arguing with and threatening Curtis’ brother. The brother had been partly at fault for starting the altercation with Wilson. Curtis was charged with second-degree murder. At trial, the court instructed the jury, over Curtis’ objection, that Curtis was justified in killing Wilson only if his brother had been entirely blameless. Curtis was convicted and he appealed.
