Facts
Fred Fixler (defendant) paid models to perform sexual acts while being photographed. Fixler’s primary motivation in hiring the models was to photograph the sexual acts. The government (plaintiff) charged Fixler with pandering, which was defined as inducing people to engage in prostitution. The trial court convicted Fixler. Fixler appealed.
