Facts
On February 20, 1977, Fuller (defendant) and an accomplice participated in the burglary of an automobile parked in a car lot. They broke into four vans on the lot and took spare tires from each of them. An officer observed Fuller and his accomplice rolling the tires to their car. The officer approached them to investigate. Fuller and his accomplice got into their car and sped away. While fleeing, they ran a red light and hit another car, causing the other driver’s death. Fuller was charged with murder under the felony-murder rule. The trial court struck the murder charges.
