People v. Galle
New York Court of Appeals
77 N.Y.2d 953 (1991)

- Written by Carolyn Strutton, JD
Facts
Galle (defendant) and his girlfriend had a substantial quantity of cocaine and planned on using all of it one night. Galle twice injected his girlfriend with some of the cocaine and knew that she planned to continue taking injections of the cocaine after those first two rounds. Galle’s girlfriend later administered more injections of the cocaine to herself and died from an overdose. Galle was charged with criminally negligent homicide. At the trial, medical testimony established that all of the injections, and not just the final injection, had been contributing causes of her death. Galle was convicted and appealed, alleging that the evidence was insufficient to support the verdict.
