Facts
Geraci (defendant) was convicted of manslaughter and assault. During the grand-jury proceedings, an eyewitness provided testimony implicating Geraci. The eyewitness then moved out of state and refused to testify at trial. The state accused Geraci of procuring the witness’s unavailability through misconduct, and the eyewitness’s grand-jury testimony was admitted at trial over Geraci’s objection. Following his conviction, Geraci appealed, arguing the admission of the grand-jury testimony was hearsay and violated his Sixth Amendment right to confront his accuser.
