Facts
Frank Moore was shot several times and seriously injured. Winifred Mitchell Green (defendant) was charged with hiring someone to kill Moore. At trial, the prosecution introduced into evidence, over Green’s objection, testimony of Lela Mae Clark, Green’s sister-in-law, regarding an incident that had occurred at Clark’s house a few weeks after Moore was shot. Specifically, Clark stated that she heard Green’s wife yell at Green that “she wasn’t scared of him just . . . because he had Frank [Moore] shot.” According to Clark’s testimony, Green did not respond to the statement. Green was convicted of conspiracy to commit murder, attempted murder, and criminal solicitation. He appealed.
